Shareholder Sues Nokia Over Lackluster Windows Phone Sales

Nokia (NOK), which earlier this week filed a patent-related lawsuit against Research In Motion (RIMM), HTC (2498TW) and visual technology company Viewsonic Corp., found itself on the receiving end today, thanks to one of its shareholders.

As All Things Digital reports, Robert Chmielinski filed a class action suit against Nokia, alleging it misled investors with the promise that its transition to Microsoft (MSFT) Windows Phone platform would revive its smartphone sales. The suit also claims that the company botched the launch of the Lumia 900.

Defendants told investors that Nokias conversion to a Windows platform would halt its deteriorating position in the smartphone market. It did not, the lawsuit states. This became apparent on April 11, 2012, when Nokia disclosed that its first quarter performance would be worse than expected. Nokia expected its first quarter 2012 non-IFRS Devices & Services operating margin to fall by 3%, and projected first quarter 2012 Devices & Services net sales of 4.2 billion.

Nokia stated it will defend itself against the claims, which it says are without merit.

Nokia stock was recently down 3.3%, well ahead of the Nasdaq‘s 1.9% fall.
